Section 01Agreement to These Terms
WonderClaus ("WonderClaus," "we," "our," or "us") provides family-oriented online Christmas entertainment experiences, including interactive virtual character conversations, scheduled visits, personalized Christmas content, Santa letters, Nice List certificates, downloadable materials, and related services.
By accessing the WonderClaus website, creating an account, purchasing an experience, scheduling a visit, or permitting a child to participate in a WonderClaus experience, you agree to these Terms of Use.
Section 02Parent/Guardian-Only Accounts
WonderClaus accounts may be created only by an adult parent or legal guardian, or another adult who has appropriate authorization from the child's parent or legal guardian. Children are not permitted to create WonderClaus accounts.
All purchases, scheduling, consent choices, child-personalization information, account management, and privacy requests must be handled by the parent or guardian. WonderClaus may use age-screening, parental verification, or verifiable parental-consent procedures where required by applicable law.
Section 03The WonderClaus Experience
WonderClaus is an entertainment service designed to create a fun and imaginative Christmas experience. Experiences may include interactive conversations with virtual characters such as Santa Claus, Mrs. Claus, Rudolph, the Chief Elf, and other original WonderClaus characters.
Characters may use artificial intelligence, speech-recognition technology, synthetic or computer-generated voices, animation, avatar technology, and automated conversational systems. WonderClaus characters are fictional entertainment experiences and are not actual persons.
Section 04Artificial Intelligence Disclosure
Parents acknowledge that WonderClaus experiences may be generated or assisted by artificial intelligence and other automated technologies. AI-generated responses may occasionally be unexpected, incomplete, inaccurate, repetitive, or different from what a human performer might say.
WonderClaus intends to use reasonable safeguards and character instructions designed to produce family-friendly, age-appropriate interactions; however, no artificial-intelligence system can guarantee perfect responses in every circumstance. Parents are encouraged to remain reasonably available while their child participates.
Section 05Children's Privacy and Personalization
WonderClaus seeks to collect only information reasonably necessary to provide the selected experience. A parent may voluntarily provide limited personalization information such as the child's first name, age or age range, preferred character, preferred language, Christmas interests or wishes, favorite activities, accomplishments, acts of kindness, and limited information necessary to personalize a Santa letter, certificate, or conversation.
Parents should not submit unnecessary sensitive information concerning a child. WonderClaus does not require a child's Social Security number, government identification number, personal telephone number, personal email address, school name, precise home location, passwords, financial information, or other information unnecessary to provide the experience.
Section 06Voice and Conversation Data
Interactive experiences may require processing of a participant's voice in real time so that the selected virtual character can understand and respond. The Privacy & Children's Privacy Policy must accurately describe whether audio, transcripts, recordings, or other conversation data are temporarily processed, retained, or deleted and the purposes for which they are used.
WonderClaus should not intentionally use a child's conversation data for unrelated behavioral advertising. Any optional recording or keepsake feature involving a child's voice, image, or conversation should use separate parental notice and consent where required.
Section 07Parent Supervision
WonderClaus is family entertainment and is not intended to replace parental supervision. Parents and guardians are responsible for determining whether the experience is appropriate for their child and for remaining reasonably available during the experience.
WonderClaus characters do not provide medical, mental-health, legal, educational, emergency, or other professional advice.
Section 08Scheduling and Session Duration
Live experiences may be limited to the duration stated at purchase, such as approximately five minutes. Scheduled customers should connect at the designated time and complete any microphone, browser, or device checks beforehand.
Late arrival may reduce available interaction time where necessary to protect subsequent reservations. Any grace period, rescheduling option, or no-show policy should be disclosed before purchase.
Section 09Waiting Room and Character Availability
During periods of high demand, customers may be placed in a virtual WonderClaus waiting room. Estimated waiting times are estimates and are not guarantees.
WonderClaus may offer the parent the opportunity to continue waiting, select another available character, schedule a later visit, reschedule an existing visit, or use an applicable WonderClaus session credit. Character availability may change without notice.
Section 10Technical Interruptions and Graceful Recovery
WonderClaus relies upon internet connectivity and third-party technology providers. If a paid experience cannot be completed because of a verified WonderClaus or service-provider technical failure, WonderClaus may reconnect the session, permit another attempt, reschedule the experience, issue a replacement session credit, or provide another reasonable remedy consistent with the applicable purchase policy.
Customers should not be required to repurchase an experience solely because of a qualifying platform-side failure. Failures caused solely by the customer's device, internet connection, unsupported browser, denied microphone permissions, or failure to attend a scheduled visit may be treated differently.
Section 11Payments
Prices are displayed before purchase. The parent or adult purchaser authorizes WonderClaus and its payment processor to charge the displayed amount, including applicable taxes and authorized additions. Children are not permitted to submit payment information.
Section 12Refunds, Rescheduling, and Personalized Digital Products
Because WonderClaus provides scheduled digital entertainment experiences and personalized digital products, refund eligibility may depend upon the circumstances. The checkout page should clearly disclose the applicable cancellation, refund, and rescheduling rules before purchase.
Personalized Santa letters, Nice List certificates, and other customized digital products may become non-refundable after generation or delivery, except where required by law or where the product is materially defective. Nothing in these Terms limits non-waivable consumer rights.
Section 13Personalized Letters and Certificates
Personalized Santa letters, Nice List certificates, and similar products are provided solely for personal, family, noncommercial entertainment use. Customers may print purchased materials for their household but may not reproduce, resell, distribute, or modify them for commercial purposes without written permission.
Section 14Intellectual Property
The WonderClaus name, logos, website design, original character designs, graphics, scripts, prompts, videos, certificates, letters, software, marketing materials, and other original content may be protected by trademark, copyright, or other intellectual-property laws. No ownership rights are transferred to customers through purchase or website use.
Section 15Acceptable Use
Users may not bypass payment or session limits; interfere with website security; reverse engineer protected portions of the service; intentionally prompt characters to produce obscene, violent, sexual, hateful, illegal, or otherwise inappropriate content; harass or misuse the service; use automated systems to overload the platform; impersonate another parent or guardian; submit information about a child without appropriate authority; or commercially reproduce WonderClaus content without permission.
WonderClaus may terminate or restrict sessions that violate these requirements.
Section 16Language Services
WonderClaus may offer experiences in English, Spanish, and potentially additional languages. AI-generated translation, speech recognition, pronunciation, or conversational responses may occasionally contain errors. Language availability may differ among characters or services.
Section 17Service Availability
WonderClaus is a seasonal technology-enabled entertainment service. We do not guarantee uninterrupted or error-free availability. WonderClaus may temporarily limit immediate visits, activate waiting-room procedures, restrict new reservations, or adjust character availability when necessary to protect service quality.
Section 18Third-Party Services
WonderClaus may rely on service providers for artificial intelligence, voice processing, avatar animation, hosting, content delivery, payments, email, scheduling, analytics, security, and customer support. Use of such providers will be governed by WonderClaus's agreements with those providers and described as appropriate in the Privacy Policy.
Section 19Disclaimer
WonderClaus provides entertainment services on an "as available" basis to the fullest extent permitted by applicable law. WonderClaus does not guarantee that every AI-generated response will be error-free, that every character will always be available, or that every child will react to the experience in the same manner.
Section 20Limitation of Liability
To the fullest extent permitted by applicable law, WonderClaus and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Any monetary limitation of liability should be finalized by licensed counsel based upon the operating entity and jurisdictions in which the service will be offered.
Section 21Changes to These Terms
WonderClaus may update these Terms to reflect changes in the service, technology, business practices, or applicable law. Material changes will be communicated where legally required.
Section 22Governing Law and Dispute Resolution
The governing-law, venue, arbitration, class-action waiver, and dispute-resolution provisions should be completed by WonderClaus's licensed attorney after the final operating entity and principal jurisdiction are established.
